Chapter 1 General Rules

Article 1Scope of Application

  1. This Conditions of Carriage apply to the carriage of checked baggage and parcels on routes operated by our Company.
  2. Matters not stipulated in this Conditions of Carriage are subject to the provisions of laws and regulations or general customs.
  3. If our Company accepts an application for a special contract within the scope not contrary to the purpose of this contract of carriage and the provisions of laws and regulations, it will be subject to the special contract.

Article 2Definition

  1. The term “checked baggage” as used in this Conditions of Carriage means that the passenger entrusts the carriage for the boarding section and falls under any of the following items.
    • Goods with a sum of the lengths of the three sides of 2 meters or less and a weight of 30 kilograms or less
    • Wheelchairs (limited to those used by passengers)
    • Assistance dogs for the physically handicapped (guide dogs, service dogs and hearing dogs stipulated in Article 2 of the Assistance Dogs for the Physically Handicapped Act (Act No. 49 of 2002) and those labeled according to the provisions of Article 12 of the same law)
  2. In this Conditions of Carriage, “parcel” means a parcel with a sum of the lengths of the three sides of 2 meters or less and a weight of 30 kilograms or less, which is entrusted by us.
  3. In this Conditions of Carriage, the term “applicant for carriage” means a passenger entrusted with the carriage of checked baggage or a person entrusted with the carriage of parcels.
  4. The term “business office” as used in this Conditions of Carriage means our office, the office of a person designated by us, and our web page on the Internet.
  5. In this Conditions of Carriage, “checked baggage ticket or parcel ticket” means an electronic certificate hail (hereinafter referred to as “electronic checked baggage ticket or electronic parcel ticket”” issued in our office and recorded in our electronic database) or a paper certificate (hereinafter referred to as “paper checked baggage ticket or paper parcel ticket”).
  6. In this Conditions of Carriage, the “authentication code” means a confirmation number that can prove that you have an electronic checked baggage ticket or an electronic parcel ticket, and other items specified separately by our Company.

Chapter 2 Underwriting of Transportation

Article 3Underwriting of Transportation

  1. We will accept applications for the transportation contract for only two checked baggage per boarding (excluding those listed in paragraph 1, item 2 and item 3 of the preceding article) according to the order of application for transportation within the range of the transportation capacity of the vessel used, requesting the presentation of the certification code and the paper ticket. However, if we consider that there is no problem in consideration of the transportation capacity of the vessel used, we will accept applications for more than two.
  2. We will accept applications for a transportation contract for a limited number of 5 parcels per voyage per person applying for transportation within the range of the transportation capacity of the vessel used. However, if we consider that there is no problem in consideration of the transportation capacity of the vessel used, we will accept applications for more than 5 parcels.
  3. Notwithstanding the provisions of Paragraph 2, our Company may refuse to apply for a transportation contract or cancel the already concluded transportation contract if any of the following items apply.
    • When our Company take measures pursuant to the provisions of Article 6
    • If your checked baggage or parcel falls under any of the following:
      • Incomplete packing or tag, fragile, odorous, filthy, or anything else that may cause inconvenience to passengers
      • Platinum, gold and other precious metals, coins, banknotes, securities, stamps, jewelry, fine arts, antiques and other items that exceed the price limits set by our Company.
      • Guns, swords, and other items that may cause harm to passengers, other goods, or vessels used.
      • Explosives and other items that may cause harm to passengers, other goods, or vessels used
      • Corpse
      • Live animals (excluding those that fall under Article 2, Paragraph 1, Item 3)
      • Other items deemed inappropriate for transportation
    • When the applicant for carriage has performed or is likely to violate the law or the provisions of this Conditions of Carriage.
    • When the application for the contract of carriage is based on the conditions of carriage different from this Conditions of Carriage
    • When a special burden is requested by the transportation applicant regarding the transportation

Article 4Declaration of Contents, etc.

  1. If the checked baggage or parcel falls under any of the items in Paragraph 3, Item 2 of the preceding Article, the applicant for carriage must declare to us that fact. (If the item corresponds to the same item a, c or d (hereinafter referred to as “dangerous goods, etc.”), the name, nature and other information necessary for the safe transportation of the dangerous goods are also needed.)
  2. When our Company comply with an application for the carriage of checked baggage or parcels that falls under any of the items of Paragraph 3, Item 2 of the preceding Article, we may request the applicant of the checked baggage or parcels to bear the burden to take guardians, non-life insurance coverage and other necessary measures.
  3. If we suspect that the checked baggage or parcel falls under any of the items in Paragraph 3, Item 2 of the preceding Article, we may check the contents of the checked baggage or parcel in the presence of the applicant for carriage or a third party.
  4. Regarding the carriage of checked baggage or parcels that fall under item 2 (a) of paragraph 3 of the preceding article (referred to as “expensive goods” in the next paragraph), our Company will not be liable for any harm caused by its loss or damage except when the applicant for carriage specifies the type and price of the checked baggage or parcels at the time of application.
  5. The provisions of the preceding paragraph do not apply in the following cases.
    • When we knew that it was an expensive item at the time of the contract of carriage
    • When the loss or damage of an expensive item is caused by the intentional or gross negligence of our Company or employees

Article 5Return, Landing on the Way, etc.

  1. We will not accept returns, transfers, midway landings or other requests for checked baggage or parcels, except for the following. However, this does not apply if we find that there is no problem in handling.
    • Return of checked baggage or landing on the way when the applicant cancels boarding or disembarks on the way
    • Transfer of checked baggage to the port of transit when the applicant for carriage passes over
    • Return of parcels or landing on the way when the contract of carriage is canceled
  2. The fare and other costs required when our Company responds to the request of the carriage applicant pursuant to the provisions of the preceding paragraph shall be borne by the carriage applicant.
  3. If the checked baggage or parcel is unloaded on the way, the transportation of the checked baggage or parcel will be deemed to have been completed.

Article 6Cancellation of Operations, etc.

  1. In addition to the provisions of laws and regulations, if any of the following items apply, our Company may take measures to cancel the scheduled departure of ship or change the vessel used, date and time of departure and arrival, navigation route or port of departure and arrival.
    • When the weather or sea conditions may endanger the navigation of the vessel
    • In the event of a natural disaster, fire, marine accident, breakdown of the vessel used, or other unavoidable reason
    • For smooth evacuation, emergency transportation and similar transportation of passengers or cargo in the event of a disaster
    • When an alliance of seafarers or other persons involved in transportation or other disputes occur
    • When there is a risk that life may be endangered or health may be significantly impaired, such as when a passenger’s illness occurs.
    • When an illegal act such as the capture or destruction of a ship in use occurs
    • When there is a good reason to believe that the passenger is performing or intending to perform any of the acts listed in each item of Article 18, Paragraph 1 of the Passenger Transport Section.
    • When there is an order or request from a public office

Chapter 3 Fares

Article 7Fare Amount, etc.

  1. The amount of fare of checked baggage or parcel (hereinafter referred to as “fare”) and its application method shall be as set forth in Paragraph 4, and shall be separately notified to the Director of the Regional Transport Bureau (including the Director of the Shipping Control Department).
  2. The fare includes the loading and unloading fee for checked baggage or parcels.
  3. The fare does not include pick-up and delivery charges for checked baggage or parcels.
  4. The fare for checked baggage listed in Article 2, Paragraph 1, Items 2 and 3 is free of charge.

Article 8Fare Collection

Our Company collect the prescribed fare at the business office and issue an electronic checked baggage ticket / a paper baggage ticket or an electronic parcel ticket / a paper parcel ticket in exchange for this.

Article 9Handling in Case of Fare Change

If the fare is changed, the checked baggage ticket or parcel ticket issued by our Company before the change will be valid.

Article 10Refunds and Refund Fees

  1. If any of the following items apply, our Company will refund the fare of the amount specified in each item at the sales office of the checked baggage ticket or parcel ticket or other business office designated by our Company.
    • When the applicant for carriage requests a refund for the checked baggage ticket or parcel ticket before the departure of the shipping service that carries the checked baggage or parcel (excluding cases corresponding to the next item), the amount recorded on the electronic checked baggage ticket (or written on the face of the paper checked baggage ticket) or recorded on the electronic parcel ticket (or written on the face of the paper parcel ticket)
    • When the transportation applicant cancels the transportation contract and requests a refund when our Company takes measures pursuant to the provisions of Article 6. The difference between amount recorded on the electronic checked baggage ticket (or written on the face of the paper checked baggage ticket) or recorded on the electronic parcel ticket (or written on the face of the paper parcel ticket) and the fare corresponding to the used section
    • When our Company cancels the carriage contract pursuant to the provisions of Article 3, Paragraph 3: The difference between the amount recorded on the electronic checked baggage ticket (or written on the face of the paper checked baggage ticket) or recorded on the electronic parcel ticket (or written on the face of the paper parcel ticket) and the fare amount corresponding to the used section
  2. When refunding the fare pursuant to the provisions of the preceding paragraph, our Company will charge a fee of the amount specified by our Company within the range of 100 yen. However, no fee will be charged for refunds pertaining to items 2 and 3 of the same paragraph (limited to cases pertaining to Article 3, paragraph 3, item 1).

Chapter 4 Receipt, Delivery, etc.

Article 11Receipt, Delivery, etc.

  1. Our Company is responsible for storing checked baggage or parcels since when we receive them from the applicant for carriage at the port of loading office until delivery at the office of the port of landing.
  2. At the landing port sales office, we will deliver the checked baggage to the bearer in exchange for the checked baggage ticket, and the parcel to the consignee listed on the parcel ticket.
  3. If the applicant for carriage loses the checked baggage ticket, the checked baggage will be delivered to the person requesting the delivery by a procedure specified separately only when our Company recognize the delivery requester as a legitimate recipient, and obtain a guarantee from the delivery requester to compensate for any loss that our Company will receive as a result of delivering the checked baggage to the requester.
  4. With respect to the checked baggage that we have delivered to the bearer of the checked baggage ticket, we will not be liable for any damages resulting from the delivery, regardless of whether the person is a legitimate recipient or not.

Chapter 5 Liability

Article 12Our Liability

  1. Regarding harms caused by the loss or damage of checked baggage or parcels, unless our Company is exempted from liability under Article 4, Paragraph 4, we will only be liable for the harms only if the accident that caused the damages to the checked baggage or parcels occurs while they are under our control.
  2. The provisions of the preceding paragraph do not apply if any of the following items apply.
    • When our Company prove that the vessel used has no structural defects or functional impairments, and that our Company and employees have taken necessary measures to prevent such damages, or that it has been impossible to take such measures due to reasons such as force majeure.
    • When our Company prove that the damage has occurred due to the intention or negligence of the applicant for carriage or a third party, or the applicant for carriage not complying with the law or this Conditions of Carriage.
  3. Our Company shall not be liable for any damages caused by our Company taking measures pursuant to the provisions of Article 6 unless our Company is liable for the damages pursuant to the provisions of Paragraph 1.

Article 13Right to Claim Damages of the Applicant for Carriage

Checked baggage and parcels delivered to the applicant for carriage or consignee without reserving shall be deemed to have waived the right to claim compensation to our Company for damages of the checked baggage and parcels. However, this may not apply if there is damage or partial loss that cannot be found immediately and the fact is notified to our Company in writing within 14 days from the date of delivery.

Article 14Claim for Compensation against the Applicant for Carriage

If the applicant for carriage causes damage to our Company due to his/her intention or negligence, or due to failure to comply with laws and regulations or this Conditions of Carriage, our Company may seek compensation for the damage from the applicant for carriage.

Chapter 6 Contact Transportation, etc.

Article 15Contact Transportation

  1. A contact checked baggage ticket or a contact parcel ticket issued by a carrier that has a contact transportation agreement with our Company shall be deemed to be our checked baggage ticket or parcel ticket for our transportation section.
  2. If we undertake transportation related to contact transportation, we will collect the fare and other expenses for transportation of all transportation sections, and in exchange, issue a contact checked baggage ticket or contact parcel ticket for transportation of all transportation sections.
  3. Regarding the transportation of checked baggage and parcels related to contact transportation, this Conditions of Carriage apply to our transportation section. However, if it is not clear who should be responsible for the loss or damage of the checked baggage or parcel, the Conditions of Carriage in favor of the applicant may be applied.
  4. Our Company shall be liable for the loss or damage of checked baggage or parcels related to contact transportation in solidarity with other carriers. In this case, any objection or notice to another carrier shall be deemed to be an objection or notice to our Company.

Article 16Common Checked Baggage Ticket and Common Parcel Ticket

  1. The common checked baggage ticket or common parcel ticket issued by the ship operator who has an agreement regarding the handling of checked baggage or parcels by the common checked baggage ticket or common parcel ticket with us is considered as our checked baggage ticket or parcel ticket.
  2. Regarding the carriage of checked baggage and parcels carried out by the common checked baggage ticket or common parcel ticket set forth in the preceding paragraph, this Conditions of Carriage applies to our transportation section.

Applicable date

This Conditions of Carriage will apply from May 10, 2021.
