Chapter 1 General Rules

Scope of Application

Article 1

1 This Conditions of Carriage apply to the carriage of special baggage on routes operated by us.

2 Matters not stipulated in this Conditions of Carriage are subject to the provisions of laws and regulations or general customs.

3 If our Company accept an application for a special contract within the scope not contrary to the purpose of this Conditions of Carriage and the provisions of laws and regulations, it will be subject to the special contract.

Definition

Article 2

1 In this Conditions of Carriage, “special baggage” means the following items and the loaded goods that the passenger entrusts with the transportation for the boarding section.

(1) Automobiles of two-wheeled stipulated in Article 2, Paragraph 2 of the Road Transport Vehicle Act (Act No. 185 of 1951)

(2) Motorized bicycle stipulated in Article 2, Paragraph 3 of the Road Transport Vehicle Act

(3) Bicycles, baby carriages, wagons and other light vehicles stipulated in Article 2, Paragraph 4 of the Road Transport Vehicle Act, which are moved manually (excluding those handled as personal belongings and checked baggage).

2 In this Conditions of Carriage, the term “applicant for carriage” means a passenger who entrusts with the carriage of special baggage.

3 The term “business office” in this Conditions of Carriage means our office, the office of a person designated by us, and our webpage on the Internet.

4 In this Conditions of Carriage, “special baggage ticket” is an electronic certificate recorded in our electronic database (hereinafter referred to as “electronic special baggage ticket”) or a paper certificate (hereinafter referred to as “paper special baggage ticket”) issued in our office.

5 In this Conditions of Carriage, the “authentication code” means a confirmation number that can prove that you have an electronic special baggage ticket, and other things that we separately determine.

Chapter 2 Underwriting of Transportation

Underwriting of Transportation

Article 3

1 Our Company will ask you to show your authentication code or a paper boarding ticket according to the order of application for transportation within the range of the transportation capacity of the ship, and we will accept the application for the transportation contract only for one special baggage per boarding.

2 Notwithstanding the provisions of the preceding paragraph, our Company may refuse to apply for a transportation contract or cancel the already concluded transportation contract if any of the following items apply.

(1) When our Company take measures pursuant to the provisions of Article 6

(2) When special baggage other than loaded goods falls under any of the following

A Those operated in violation of the provisions of laws and regulations

B Items for which the loading method of the loaded goods is deemed inappropriate for transportation

C Those that are recognized as having an inappropriate structure for handling, such as low ground clearance

D Those that are recognized as having an inappropriate structure for shipping and lashing

E Those that are significantly more expensive than the fare for special baggage (hereinafter referred to as the “fare”)

F Other items that may cause harm to passengers, other goods, or vessels used, or cause inconvenience to passengers.

(3) When the loaded item falls under any of the following

A Items that emit odors, items that are unclean, or items that may cause inconvenience to passengers

B Platinum, gold and other precious metals, coins, banknotes, securities, stamps, jewelry, fine arts, antiques and other items that exceed the price limits set by our Company.

C Guns, swords, and other items that may cause harm to passengers, other goods, or vessels used.

D Explosives and other items that may cause harm to passengers, other goods, or vessels used

E Corpse

F Live animals

G Other items deemed inappropriate for transportation

(4) When the applicant for carriage has performed or is likely to violate the law or the provisions of this Conditions of Carriage

(5) When the application for the carriage contract is based on the conditions of carriage different from this Conditions of Carriage

(6) When a special burden is requested by the transportation applicant regarding the transportation

Declaration of the Contents of Special Baggage, etc.

Article 4

1 If the special baggage other than the loaded goods falls under item 2 of paragraph 2 of the preceding article or the loaded goods fall under any of item 3 of the same paragraph, the applicant for carriage shall notify our Company about the fact (If the item falls under the same item a, c or d (hereinafter referred to as “dangerous goods, etc.”), the fact, the name and nature of the dangerous goods, and other information necessary for safe transportation of the dangerous goods)in advance.

2 If our Company responds to an application for the transportation of special baggage other than the loaded goods in Paragraph 2, Item 2 of the preceding Article or the loaded goods falling under any of Item 3 of the same paragraph, our Company shall bear the burden on the transport applicant. The applicant may be required to take necessary measures such as attending a guard, insuring non-life insurance, etc. for the special baggage.

3 If there is a suspicion that special baggage other than loaded goods falls under item 2 of paragraph 2 of the preceding article or that loaded goods falls under any of item 3 of the same paragraph, the contents of the special baggage may be inspected in the presence of the applicant of the carrier or a third party.

4 Regarding the transportation of special baggage other than the loaded goods in Paragraph 2, Item 2 of the preceding Article or the loaded goods falling under Item 3 (a) of the same paragraph (hereinafter referred to as “expensive items, etc.”), we will not be liable for any damage caused by its loss or damage unless the price, the type of the expensive goods, etc. is specified when the transportation applicant applies for transportation.

5 The provisions of the preceding paragraph do not apply in the following cases.

(1) When we knew that it was an expensive item at the time of concluding the transportation contract

(2) When the loss or damage of expensive items, etc. occurs due to intentional or gross negligence of our Company or its employees

Disembarkation on the way, etc.

Article 5

1 We do not accept special baggage disembarkation or other requests. However, this does not apply if we find that there is no problem in handling.

2 The fare and other costs required when our Company responds to the request of the carriage applicant pursuant to the proviso of the preceding paragraph shall be borne by the carriage applicant.

Cancellation of Operations, etc.

Article 6

In addition to the provisions of laws and regulations, if any of the following items apply, we will cancel the scheduled departure of the shipping service, the vessel used, the date and time of departure and arrival, or change the navigation route, the port of departure and arrival, or limit the type of special baggage. (Except the types of goods to be loaded. The same shall apply hereinafter.)

(1) When the weather or sea conditions may endanger the navigation of the ship

(2) In the event of a natural disaster, fire, marine accident, breakdown of the vessel used, or other unavoidable reason

(3) For smooth evacuation, emergency transportation and similar transportation of passengers or cargo in the event of a disaster

(4) When an alliance of seafarers or other persons involved in transportation or other disputes occur

(5) When there is a risk of life-threatening or serious health loss, such as when a passenger’s illness occurs.

(6) When an illegal act such as the capture or destruction of a ship in use occurs

(7) When there is a good reason to believe that the passenger is performing or intending to perform any of the acts listed in each item of Article 18, Paragraph 1 of the Passenger Transport Section.

(8) When there is an order or request from a public office

Chapter 3 Fares

Fare Amount, etc.

Article 7

1 The amount of the fare and its application method will be determined separately by notifying the director of the regional transport bureau (including the director of the transport control department).

2 The fare does not include the fare and charges for the carriage of the applicant.

Fare collection

Article 8

1 We will collect the prescribed fare at the sales office and issue an electronic special baggage ticket or a paper special baggage ticket in exchange.

2 If the applicant for carriage boarded the special baggage without paying the fare with the consent of the captain or our staff, we will charge the fare corresponding to the boarding section on board, and in exchange for this, we will issue a supplementary special baggage ticket.

Validity of Special Baggage Ticket

Article 9

1 Electronic special baggage tickets can be used only for the boarding section, valid period, designated ship (meaning the ship for which the date of boarding and ship number or departure time are specified. The same shall apply hereinafter) and the type of special baggage recorded on the electronic database (or in case of paper special baggage tickets, stated on the ticket).

2 When we confirm the validity of a special baggage ticket, presentation of the authentication code (or a paper special baggage ticket) is required.

3 If the applicant for carriage disembarks the special baggage in the boarding section indicated on the face of the special baggage ticket for his/her reason, the advance of the special baggage ticket will be invalid. However, this does not apply to transfers and other cases specified in this Conditions of Carriage.

Handling in Case of Fare Change

Article 10

If the fare is changed, the special baggage ticket issued by our Company before the change will be valid only within the valid period.

Valid Period of Special Baggage Ticket

Article 11

1 Regarding the valid period of special baggage tickets (excluding those related to designated ships), we will set a period longer than the period specified in each of the following items according to the classification specified in each item, and record this on the electronic special baggage ticket (or write it on the face of the paper special baggage ticket).

(1) One-way ticket: According to the following categories depending on the one-way boarding distance, the period specified in each category

A For items less than 100 kilometers, only on the day of release

B For items over 100 kilometers and less than 200 kilometers, 2 days including the day of release

C For items over 200 kilometers and less than 400 kilometers, 4 days including the day of release

D For items over 400 kilometers, 7 days including the day of release

(2) Round-trip ticket: Depending on the one-way boarding distance for the round-trip ticket, the period is twice the period specified in each category according to the category of the previous item.

(3) Coupon Ticket: Two months including the day of sale

2 Due to illness or other force majeure concerning the applicant for carriage or our Company taking measures pursuant to the provisions of Article 6, when the applicant for carriage postpones or becomes unable to continue to board special baggage, we will handle the unused section of the special baggage ticket for an extension of the valid period up to 7 days.

3 If the valid period of the special baggage ticket has passed after boarding the special baggage, the valid period of the special baggage ticket will be deemed to have been extended during that period as long as the special baggage ticket continues to be boarded.

Boarding Change

Article 12

1 If the applicant for carriage requests to change the boarding section, designated ship or special baggage type recorded on the electronic special baggage ticket (or written on the face of the paper special baggage ticket) (Excluding coupon special baggage tickets and regular special baggage tickets) before the end of the valid period (for those related to designated ship, before the departure of the designated ship) of the ticket, our Company will comply with the request only once. Ticket sales offices and other offices designated by us will handle it. However, this does not apply if there is not enough transportation capacity such as ship to be changed.

2 If our Company comply with the handling of the change pursuant to the provisions of the preceding paragraph, the fee for the change shall be free of charge. If there is a difference between the amount of the fare corresponding to the changed boarding section and the type of special baggage and the amount of the fare already received, we will charge for the shortfall and refund the excess.

Passing Over

Article 13

If the applicant for carriage requests to change the boarding section stated on the face of the special baggage ticket after boarding the special baggage, we will comply with the change only if the transportation capacity is sufficient and it will be a transfer. In this case, our Company will charge the difference between the fare amount corresponding to the changed boarding section and the fare amount already received, and will issue a supplementary special baggage ticket in exchange for this.

Loss of Paper Special Baggage Ticket

Article 14

1 If the applicant loses the paper special baggage ticket, we will charge the fare again and issue a paper special baggage ticket in exchange for it. In this case, we will issue a certificate to that effect. However, this provision may not apply if it is clear that you have a paper special baggage ticket and boarded the special baggage.

2 If the applicant for carriage finds a lost paper special baggage ticket, he/she may request our Company to refund the fare with the certificate set forth in the preceding paragraph within one year after the expiration of the valid period.

Unauthorized Boarding, etc.

Article 15

If the applicant for carriage commits any of the following acts, our Company may charge an additional fare equivalent to twice that amount in addition to the fare. In this case, if the port of embarkation is unknown, the port of departure of the relevant shipping service will be deemed to be the port of embarkation.

(1) To board special baggage without holding an authentication code or a paper special baggage ticket without the consent of the captain or our staff.

(2) To board special baggage with an invalid authentication code or a paper special baggage ticket.

(3) To board special baggage with an authentication code or a paper special baggage ticket with modified information.

(4) To board special baggage other than the type of special baggage stated on the authentication code or the face of the paper special baggage ticket.

(5) Not responding to requests by our staff to show authentication code, paper special baggage ticket, or to pay the fare.

(6) To receive a discount on the fare or to board special baggage without paying the fare due to fraudulent declaration.

(7) Refusing to deliver the paper special baggage ticket when collecting it.

Refunds and Refund Fees

Article 16

1 If any of the following items apply, our Company will refund the fare of the amount specified in each item at the sales office of the special baggage ticket or other offices designated by us.

(1) When the applicant for carriage requested a refund within the valid period for special baggage tickets that are not designated ship before passing the ticket gate (excluding coupon special baggage tickets and regular special baggage tickets; the same shall apply hereinafter in this article) (excluding cases corresponding to No. 3 and No. 5), the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket). (If discounted, the amount after discount. The same shall apply hereinafter)

(2) If the applicant for carriage requests a refund for the special baggage ticket for the designated ship before passing the ticket gate and departing (excluding cases corresponding to the next item and item 5), the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket).

(3) When requesting a refund within 30 days after the expiration of the valid period of the special baggage ticket in case that the applicant has stopped or cannot continue to board special baggage due to death, illness or another force majeure related to the applicant, the difference between the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket) and the fare corresponding to the used section

(4) When the applicant for carriage requests a refund for the coupon special baggage ticket before passing the ticket gate within the valid period, it is obtained by multiplying the amount of the fare before the number of times of boarding section stated on the ticket by the number of used tickets. Amount obtained by deducting the amount from the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket)

(5) When the applicant for carriage requests a refund for the regular special baggage ticket within the valid period, amount obtained by multiplying the round-trip fare amount of the boarding section recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket) (if there is a round-trip discount, the discounted fare amount) and the number of days elapsed since the start date and deducting the amount obtained from the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket)

(6) When the transportation applicant cancels the transportation contract and requests a refund when our Company takes measures pursuant to the provisions of Article 6, the difference between the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket) and the fare corresponding to the used section

(7) When our Company cancel the transportation contract pursuant to the provisions of Article 3, Paragraph 2, the difference between the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket) and the amount of the fare corresponding to the used section

(8) When the transportation applicant requests a refund pursuant to the provisions of Article 14, Paragraph 2, amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket)

2 When refunding the fare pursuant to the provisions of the preceding paragraph, our Company will charge a fee of the amount specified by our Company within the range of the amount specified in each of the following items according to the categories specified in each item. However, no fee will be charged for refunds pertaining to items 6 and 7 of the same paragraph (limited to cases pertaining to Article 3, paragraph 2, item 1).

(1) Refund of 200 yen for items 1, 3, 4, 7 (excluding cases related to Article 3, Paragraph 2, Item 1) and Item 8 of the preceding paragraph

(2) Refund pertaining to item 2 of the preceding paragraph

A Refund of 200 yen for requesting until 7 days before the departure date

B Refund for requesting until the day before the departure date, amount equivalent to 10% of the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket) (200 yen if the amount is less than 200 yen)

C Refund for requesting by the departure time, amount equivalent to 30% of the amount recorded on the electronic special baggage ticket (or stated on the face of the paper special baggage ticket) (200 yen if the amount is less than 200 yen)

D The refund fee for a special baggage transportation ticket whose reservation has been changed by the passenger pursuant to the provisions of Article 12 is the refund fee for the original reservation at the time of changing the reservation or the refund fee for the changed reservation at the time of requesting the refund of the changed reservation. One of the higher of these refund fees will be charged.

Chapter 4 Obligations of Carriage Applicants

Loading and Landing

Article 17

1 The loading and unloading of special baggage shall be carried out by the applicant for carriage in accordance with the instructions of the captain or our staff.

2 When loading and unloading special baggage, the driver of special baggage must operate the handlebars, brakes and other devices of the special baggage without fail, and he/she must drive at a speed and method that there is no harm to others depending on the situation of the loading and unloading facility and the special baggage.

Obligation to Inspect

Article 18

The applicant for carriage must check for special baggage before disembarking. In this case, if you find any abnormality in the special baggage, you must immediately report it to the captain or our staff.

Prohibitions of Drivers of Special Baggage, etc.

Article 19

1 When driving a special baggage to board or disembark, the driver of the special baggage must slow down on board or at the boarding/alighting facility or taxiway, and must not interrupt in front of the vehicle or other special baggage being boarded/disembarked.

2 The driver of special baggage must follow the job instructions given by the captain or our staff to ensure the safety of transportation regarding the loading and unloading of special baggage.

3 The captain may order the driver of special baggage who does not follow the instructions in the preceding paragraph to disembark.

Chapter 5 Liability

Our Liability

Article 20

1 Regarding damages caused by the loss or damage of special baggage, unless our company is exempted from liability under Article 4, Paragraph 4, we will be liable only if the accident that caused the damage to the special baggage occurs under the control of us.

2 The provisions of the preceding paragraph do not apply if any of the following items apply.

(1) When our Company prove that the vessel used has no structural defects or functional impairments, and that our Company and employees have taken necessary measures to prevent such damages, or that it has been impossible to take such measures due to reasons such as force majeure.

(2) When our Company proves that the damage has occurred due to the intention or negligence of the applicant for carriage or a third party, or the applicant for carriage not complying with the law or this Conditions of Carriage.

3 Our Company shall not be liable for any damages caused by our Company taking measures pursuant to the provisions of Article 6 unless our Company is liable for the damages pursuant to the provisions of Paragraph 1.

Right to Claim Damages of the Applicant for Carriage

Article 21

Special baggage delivered to the applicant for carriage without objection shall be deemed to have waived the right to claim compensation to our Company for damages of the special baggage. However, this may not apply if there is damage or partial loss that cannot be found immediately and the fact is notified to our Company in writing within 14 days from the date of delivery.

Claim for Compensation against the Applicant for Carriage

Article 22

If the applicant for carriage causes damage to our Company due to his/her intention or negligence, or due to failure to comply with laws and regulations or this Conditions of Carriage, our Company may seek compensation for the damage from the applicant for carriage.

Chapter 6 Common Special Baggage Ticket

Common Special Baggage Ticket

Article 23

1 A common special baggage ticket issued by a shipping operator that has an agreement regarding the handling of special baggage with the common special baggage ticket will be deemed to be our special baggage ticket.

2 Regarding the carriage of special baggage carried out by the common special baggage ticket set forth in the preceding paragraph, this Conditions of Carriage apply to our carriage section.

Applicable date

This Conditions of Carriage will apply from May 10, 2021.
