Chapter 1 General Rules

Article 1Scope of Application

  1. This Conditions of Carriage applies to the carriage of passengers and personal belongings on the routes operated by our Company.
  2. Matters not stipulated in this Conditions of Carriage are subject to the provisions of laws and regulations or general customs.
  3. If our Company accepts an application for a special contract within the scope not contrary to the purpose of this Conditions of Carriage and the provisions of laws and regulations, it will be subject to the special contract.

Article 2Definition

  1. In this Conditions of Carriage, “passenger” means walking passengers, and in the case of vehicle transportation, it means the drivers, crews, passengers of the vehicle and other persons on the vehicle involved in the vehicle transportation.
  2. In this Conditions of Carriage, “adults” are those who are 12 years old or older (Except for elementary school students, which means students who go to elementary school (elementary school mentioned in School Education Act (Act No. 26 of 1947) Article 1, the first half of the compulsory education school, and the elementary department of the special support school, and the department similar to the elementary department of various schools in Article 134, Paragraph 1 of the same law.   3. In this Conditions of Carriage, “children” means those under the age of 12 and elementary school students 12 years old and over.
  4. In this Conditions of Carriage, “hand-carrying goods” means items that passengers carry or bring with them into the cabin and fall under any of the following items.
    • Goods with a sum of the lengths of the three sides of 2 meters or less and a weight of 30 kilograms or less
    • Wheelchairs (limited to those used by passengers)
    • Assistance dogs for the physically handicapped (guide dogs, service dogs and hearing dogs stipulated in Article 2 of the Assistance Dogs for the Physically Handicapped Act (Act No. 49 of 2002), and labeled according to the provisions of Article 12 of the same law.)
  5. In this Conditions of Carriage, the term “business office” means our office, the office of a person designated by us, and our webpage on the Internet.
  6. In this Conditions of Carriage, the term “boarding ticket” means an electronic ticket recorded in our electronic database (hereinafter referred to as “electronic boarding ticket”) or a piece of paper certificate (hereinafter referred to as “paper boarding ticket”) that is issued by our office.
  7. In this Conditions of Carriage, the “authentication code” means a confirmation number that can prove that you have an electronic ticket, and other things that we separately determine.

Chapter 2 Underwriting of Transportation

Article 3Underwriting of Transportation

  1. We will accept applications for transportation contracts for passengers and personal belongings according to the order of application for transportation within the range of the transportation capacity of the vessel used.
  2. Notwithstanding the provisions of the preceding paragraph, our Company may refuse to apply for a transportation contract or cancel the already concluded transportation contract if any of the following items apply.
    • (1) When our Company takes measures pursuant to the provisions of Article 5
    • (2) If the passenger falls under any of the following
      • Patients (including pseudo-symptomatic patients and asymptomatic pathogen carriers) of infectious diseases such as first-class infectious diseases, second-class infectious diseases, new influenza, etc. or designated infectious diseases (limited to those requiring hospitalization) according to the Act on Prevention of Infectious Diseases and Medical Care for Patients with Infectious Diseases (Act No. 114 of 1998), or those with findings of new infectious diseases
      • Drunk people, drug addicts and others who may be a nuisance to other passengers
      • A seriously ill person or a child who is not in elementary school and has no attendant
      • Persons whose life may be endangered or their health may be significantly impaired due to age, health or other reasons
    • When the Passenger acts or is likely to violate the law or the provisions of this Conditions of Carriage
    • When the Passenger acts or is likely to violate the law or the provisions of this Conditions of Carriage
    • When the applicant requests a special burden for the transportation

Article 4Bringing in Personal Belongings, etc.

  1. Passengers may bring only two personal belongings (excluding those listed in Article 2, Paragraph 4, Items 2 and 3; the same shall apply hereinafter in this paragraph) into the cabin. However, in consideration of the size of personal belongings, the transportation capacity of the ship on board, etc., if we find that there is no problem, passengers can bring in more than two.
  2. Notwithstanding the provisions of the preceding paragraph, our Company may refuse to bring in personal belongings that fall under any of the following items.
    • Items that emit odors, items that are unclean, or items that may cause inconvenience to passengers
    • Guns, swords, and other items that may cause harm to passengers, other goods, or vessels used.
    • Explosives and other items that may cause harm to passengers, other goods, or vessels used
    • Corpse
    • Live animals (excluding those listed in Article 2, Paragraph 4, Item 3)
    • Other items deemed inappropriate for transportation
  3. If there is a suspicion that the personal belongings fall under any of the items in the preceding paragraph, our Company may inspect the contents of the personal belongings in the presence of the passenger or a third party.

Article 5Cancellation of Operations, etc.

  1. In addition to the provisions of laws and regulations, if any of the following items apply, our Company may take measures to cancel the scheduled ship, or change the vessel used, date and time of departure and arrival, navigation route or port of departure and arrival.
    • When the weather or sea conditions may endanger the navigation of the ship
    • In the event of a natural disaster, fire, marine accident, breakdown of the vessel used, or other unavoidable reasons
    • For smooth evacuation, emergency transportation and similar transportation of passengers or cargo in the event of a disaster
    • When an alliance of seafarers or other persons involved in transportation or other disputes occur
    • When there is a risk that life may be endangered or health may be significantly impaired, such as when a passenger’s illness occurs.
    • When an illegal act such as the capture or destruction of a ship in use occurs
    • When there is a good reason to believe that the passenger has performed or intends to perform any of the acts listed in each item of Article 18, Paragraph 1
    • When there is an order or request from a public office

Chapter 3 Fares and Charges

Article 6Fares and Charges, etc.

  1. Regarding the fare and charges (hereinafter referred to as “fares and charges”) for passengers (excluding the driver of the vehicle involved in vehicle transportation) and personal belongings (hereinafter referred to as “fares and charges”) and the application method, it depends on the provisions of paragraphs 3 to 5, and on the notification to the director of the regional transport bureau (including the director of the transport supervision department).
  2. Fares and charges do not include passenger meals.
  3. Fares and charges for children who fall under any of the following items are free of charge. However, this does not apply to fares and charges when a reserved seat or a sleeper is used by a child.
    • Children under 1 year old
    • Children over 1 year old who are not attending elementary school and are accompanied by an adult (excluding those who board as a group and when more than one child are accompanied by one adult)
  4. There is no charge for hand-carried items with a total weight of 20 kg or less.
  5. The charges for personal belongings listed in Article 2, Paragraph 4, Items 2 and 3 are free of charge.

Article 8Collection of fares and charges

  1. Our Company collect the prescribed fare and charges at the business office and issue an electronic boarding ticket or a paper boarding ticket in exchange.
  2. If a passenger boarded the ship without paying the fare and charges with the consent of the captain or our staff (hereinafter referred to as “sailors, etc.”), the fare and charges corresponding to the boarding section, grade and cabin will be charged in the ship. In exchange for this, we will issue a supplementary boarding pass.
  3. When transporting a car and the driver of the car intends to board a cabin other than the lowest grade, our Company shall consider the fare and charges corresponding to the cabin and the lowest grade cabin fare. We will charge the difference from the amount and issue a supplementary boarding ticket in exchange.

Article 9Validity of boarding ticket

  1. The electronic boarding pass can be used only on the boarding section, valid period, designated ship (ship which boarding date and ship number or departure time are designated. The same shall apply hereinafter), grade and cabin recorded on the electronic database (in the case of a paper ticket, it is written on the ticket).
  2. The boarding pass can only be used by the registered person and cannot be transferred to a third party.
  3. When we confirm the validity of the boarding pass, it is needed to show the verification code (or a paper boarding pass).
  4. If a passenger disembarks on the way within the boarding section recorded on the electronic boarding ticket (excluding the commutation ticket) (or written on the face of the paper ticket (excluding the commutation ticket)) for his/her reason, the rest of the route on the ticket is invalid. However, this does not apply to transfers and other cases specified in this Conditions of Carriage.

Article 10Handling of Changes in Fares and Charges

In case of the fares and charges are changed, the boarding pass issued by our Company before the change will be valid only within the valid period.

Article 11Ticket Validity Period

  1. Regarding the valid period of boarding tickets (excluding those related to designated ships), we will set a period longer than the period specified in each of the following items according to the classification specified in each item, and record this on the electronic boarding ticket (or write it on the face of the paper boarding ticket).
    • One-way ticket: According to the following categories depends on the one-way boarding distance, the period specified in each category
      • For items less than 100 kilometers, only on the day of release
      • For items over 100 kilometers and less than 200 kilometers, 2 days including the day of release
      • For items over 200 kilometers and less than 400 kilometers, 4 days including the day of release
      • For items over 400 kilometers, 7 days including the day of release
    • Round-trip ticket: According to the classification of the previous items depending on the one-way boarding distance for the round-trip ticket, the period is double the period specified in each classification
    • Coupon ticket: Two months including the day of coupon sale
  2. If the passenger postpones or is unable to continue boarding due to illness or other force majeure related to the passenger or the measures taken by the Company pursuant to the provisions of Article 5, the Company shall. For unused sections of the boarding pass, we will handle the extension of the valid period up to 7 days.
  3. If the valid period of the ticket has passed after the passenger boarded, the valid period of the ticket will be deemed to have been extended as long as the passenger continues to board the train.

Article 12Boarding change

  1. In case a passenger requests to change the boarding section, designated flight, grade or cabin recorded on the electronic boarding ticket (or listed on the paper boarding ticket) before the end of the valid period (or before the departure of the designated flight if it is related to a designated flight) of the boarding ticket (excluding coupon boarding tickets and commutation tickets), we will only once comply with the change at the related ticket sales office or other designated office. However, this does not apply if there is not enough transportation capacity on the ship to be changed. In addition, about “planned discount product”, it depends on fare and charge application method.
  2. If our Company comply with the change in accordance with the provisions of the preceding paragraph, the fee for the change shall be free of charge, and if there is a difference between the fare and fee corresponding to the changed boarding section, grade and cabin and the fare and fee already received, we will charge it if there is a shortage and refund it if there is an excess amount.

Article 13Special Case of Boarding Change after the Designated Flight Departs

If the passenger requests to change the ship after the designated ship departs, our Company will accept the change to board the lowest grade cabin with the ticket only if the transportation capacity of other shipping services on the boarding date on the electronic boarding ticket (or on the face of the paper boarding ticket) is sufficient.

Article 14Passing over, etc.

If a passenger requests to change the boarding section, grade or cabin recorded on the electronic ticket (or written on the paper ticket) after boarding, our Company will only handle the change to higher grades or cabins or passing over, only when there is sufficient transportation capacity. In this case, we will charge the difference between the fare before and after the change corresponding to the changed boarding section, grade and cabin, and will issue a supplementary boarding ticket in exchange.

Article 15Loss of Paper Boarding Pass

  1. If a passenger loses a paper ticket, we will charge the fare and charges again and issue a paper ticket in exchange. In this case, we will issue a certificate about it. However, this provision may not apply if it is clear that you are on board with a paper ticket.
  2. When a passenger finds a lost paper ticket, he / she may request our Company to refund the fare and charges with the certificate set forth in the preceding paragraph within one year after the expiration of the valid period.

Article 16Unauthorized Boarding, etc.

  1. If a passenger commits any of the following acts, our Company may charge an additional fare and charge equivalent to twice these in addition to the fare and charge. In this case, if the port of embarkation is unknown, the port of departure of the ship will be regarded as the port of embarkation, and if the cabin of the grade on board is unknown, the cabin of the highest grade of the ship will be regarded as the cabin of the grade.
    • Boarding without an authentication code or a paper ticket without the consent of the seafarers.
    • Boarding with an invalid authentication code or a paper ticket.
    • Boarding with an authentication code or a piece of paper ticket with modified information.
    • A person other than a person who can use the authentication code or a paper ticket use it to board the ship.
    • Not responding to requests by our staff to show authentication code or paper ticket, or request for fare and fee payment.
    • Receive discounts on fares and charges due to fraudulent declarations, or board without paying fares and charges.
    • Refusing to deliver a paper ticket when collecting it.

Article 17Refunds and Refund Fees

  1. If any of the following items apply, our Company will refund the fare and charges specified in each item at the ticket sales office or other offices designated by us.
    • When a passenger requests a refund before boarding within the valid period for a boarding ticket (excluding coupon tickets and commutation tickets; the same shall apply hereinafter in this Article) which ship is not designated (except for cases corresponding to items 3 and 7.), amount recorded on the electronic ticket (or written on the face of the paper ticket) (If discounted, the discounted amount.     • When a passenger requests a refund for a ticket for a designated ship before the departure (excluding cases corresponding to the next item and item 7), amount recorded on the electronic ticket (or stated on the paper ticket).
    • When a passenger requests a refund within 30 days after the expiration of the ticket’s validity period, in case that he/she proves that he/she has stopped or cannot continue boarding due to death, illness or other force majeures related to the passenger’s body. The difference between the amount recorded on the electronic ticket (or written on the face of the paper ticket) and the fare and charges corresponding to the used section

    • When a passenger requests a refund for a commutation ticket within the valid period, the amount of the round-trip fare and charges for the boarding section recorded on the electronic ticket (or written on the face of the paper ticket), the amount (or if there is a round-trip discount, discounted amount) obtained by multiplying the fare and fare amount by the number of days elapsed since the start date of use is deducted from the amount recorded on the electronic ticket (or stated on the face of the paper ticket).
    • When a passenger requests a refund., In case that a ship that collects a special express charge or an express charge (hereinafter referred to as “express ship”) arrives later than the time within the prescribed time required for the express service specified by our Company.     • When the passenger cancels the contract of carriage and requests a refund when our Company takes measures pursuant to the provisions of Article 5. The difference between the amount recorded on the electronic ticket (or written on the face of the paper ticket) and the fare and charges corresponding to the used section
    • When our Company cancels the transportation contract pursuant to the provisions of Article 3, Paragraph 2, the difference between the amount recorded on the electronic ticket (or written on the face of the paper ticket) and the fare and charges corresponding to the used section
    • When a passenger requests a refund pursuant to the provisions of Article 15, Paragraph 2, the amount recorded on the electronic ticket (or stated on the face of the paper ticket)
  2. When refunding fares and charges pursuant to the provisions of the preceding paragraph, our Company will charge a fee of the amount specified by the Company within the range of the amount specified in each of the following items according to the categories specified in each item. However, no fee will be charged for refunds pertaining to items 6, 7, and 8 of the same paragraph (limited to cases pertaining to Article 3, paragraph 2, item 1).
    • Refund of 200 yen for items 1 and 3 to 5 of the preceding paragraph, item 8 (excluding cases related to Article 3, paragraph 2, item 1) and item 9
    • Refund pertaining to item 2 of the preceding paragraph
      • Until 7 days before the departure date: 200 yen
      • Until the two days before the departure date: The amount equivalent to 10% of the amount recorded on the electronic ticket (or written on the face of the paper ticket) (200 yen, if the amount is less than 200 yen)
      • Until the departure time: The amount equivalent to 30% of the amount recorded on the electronic boarding ticket (or written on the face of the paper ticket) (200 yen, if the amount is less than 200 yen)
      • The refund fee for the boarding pass for which the passenger has changed the reservation pursuant to the provisions of Article 12 is the refund fee for the original reservation at the time of changing the reservation or the refund fee for the changed reservation at the time of requesting the refund. Either higher refund fee will be charged.
  3. When refunding fares and charges to which the planned product discount is applied, our Company will charge a fee of the amount specified by us within the range of the amount specified in each of the following items according to the categories specified in each item.
    • Until 7 days before the departure date: An amount equivalent to 10% of the amount recorded on the electronic ticket (or written on the face of the paper ticket) (200 yen, if the amount is less than 200 yen)
    • Until 2 days before the departure date: An amount equivalent to 30% of the amount recorded on the electronic ticket (or written on the face of the paper ticket) (200 yen, if the amount is less than 200 yen)
    • Until the departure time: The amount equivalent to 50% of the amount recorded on the electronic boarding ticket (or written on the face of the paper ticket) (200 yen, if the amount is less than 200 yen)

Chapter 4 Passenger Duties

Article 18Passenger Prohibited Acts, etc.

  1. Passengers must not act any of the following:
    • Unnecessarily operating the steering equipment of the ship or other equipment for operation or the operating device of the movable facility for passenger boarding and alighting related to the ship.
    • Unnecessarily enter a restricted area on board the ship.
    • Smoking in a place where smoking is prohibited on board the ship.
    • Unnecessarily operating or moving fire extinguishers, emergency alarms, life jackets or other devices or equipment that should be used in an emergency.
    • Unnecessarily operating or moving a device or instrument for the lateralization of automobiles or other cargo.
    • Unnecessarily operating or moving ramps, barriers and other equipment for boarding and alighting passengers or automobiles or for preventing falls.
    • Damage or move signs or notices that indicate how to board or disembark a passenger or vehicle for the safety of passengers.
    • Throw or launch stones, glass bottles, metal pieces or other properties on a ship or property that may damage people or loads on the ship.
    • Dumping goods that are prohibited from being dumped in the sea from a ship into the sea.
    • Acts that interfere with the execution of duties by seafarers, etc.
    • To cause discomfort or inconvenience to other passengers.
    • Disrupting the order or morals of the ship, or doing anything that is harmful to hygiene.
  2. Passengers must follow the job instructions given by seafarers, etc. to ensure the safety of transportation and maintain order on board, regarding boarding and disembarking and other activities on board.
  3. The captain may refuse to board or order disembarking to passengers who do not follow the instructions in the preceding paragraph.

Article 19Storage of Hand-Carried Goods

Passengers themselves are responsible for storing personal belongings brought into the cabin.

Chapter 5 Liability

Article 20Our Liability

  1. From the time when the passenger reaches the boarding and alighting facility at the embarkation port (if there is a ticket gate, the ticket gate; the same shall apply hereinafter) until the passenger leaves the boarding and alighting facility at the port of disembarkation according to the instructions of the seafarers, etc.,  if a passenger injure his/her life or body, our Company will be liable for any damages, unless we prove that the carrier has not neglected the transportation.
  2. Notwithstanding the provisions of the preceding paragraph, our Company may not be liable if any of the following items apply.
    • When transporting in the event of or is likely to cause a large-scale disaster, earthquake or other disaster
    • When transporting a person who may pose a serious risk to life or body due to vibration or other circumstances that normally occur during transportation.
  3. Our Company shall be liable for damages caused by the loss or damage of personal belongings and other items stored by passengers only when it is proved that we or our employees were intentional or negligent.
  4. Our Company shall not be liable for any damages caused by our Company taking measures pursuant to the provisions of Article 5, except when we are liable under the provisions of Paragraph 1 or the preceding paragraph.

Article 21Claims for passengers

If a passenger causes damage to our Company intentionally or negligently, or due to failure to comply with laws and regulations or this Conditions of Carriage, we may seek compensation for the damage from the passenger.

Chapter 6 Contact Transportation, etc.

Article 22Contact Transportation

  1. A contact boarding pass issued by a carrier that has an agreement on contact transportation with us will be regarded as our boarding pass for our transportation section.
  2. If we undertake transportation related to liaison transportation, we will collect the fare, charges and other expenses for transportation of all transportation sections, and in exchange for this, we will issue a contact boarding ticket for transportation of all transportation sections.
  3. Regarding the transportation of passengers and personal belongings related to contact transportation, this Conditions of Carriage apply to our transportation section.

Article 23Common boarding ticket

  1. A common ticket issued by a ship operator that has an agreement with us regarding the handling of passenger transportation using a common ticket is considered to be our ticket.
  2. Regarding the transportation of passengers and personal belongings carried out by the common ticket set forth in the preceding paragraph, this Conditions of Carriage apply to our transportation section.

Applicable date

This Conditions of Carriage will apply from May 10, 2021.
